अगर हमें संविधान के समावेशी आदर्शों को प्राप्त करना है, तो न्यायपालिका में भी महिलाओं की भूमिका बढ़ाने की आवश्यकता है : राष्ट्रपति श्री कोविंद
राष्ट्रपति श्री राम नाथ कोविंद ने कहा कि अगर हमें हमारे संविधान के समावेशी आदर्शों को अर्जित करना है, तो न्यायपालिका में भी महिलाओं की भूमिका बढ़ाने की आवश्यकता है। वह आज (11 सितंबर, 2021) उत्तर प्रदेश के प्रयागराज में उत्तर प्रदेश राष्ट्रीय विधि विश्वविद्यालय और इलाहाबाद उच्च न्यायालय के नए भवन परिसर के शिलान्यास समारोह में बोल रहे थे।
राष्ट्रपति ने 1921 में भारत की पहली महिला वकील, सुश्री कॉर्नेलिया सोराबजी को नामांकित करने के इलाहाबाद उच्च न्यायालय के ऐतिहासिक निर्णय का उल्लेख करते हुए, उस निर्णय को महिला सशक्तिकरण की दिशा में एक दूरदर्शी निर्णय करार दिया। उन्होंने कहा कि पिछले महीने सर्वोच्च न्यायालय में तीन महिला न्यायाधीशों सहित नौ न्यायाधीशों की नियुक्ति के साथ न्यायपालिका में महिलाओं की सहभागिता का एक नया इतिहास रचा गया। उन्होंने कहा कि सर्वोच्च न्यायालय में नियुक्त कुल 33 न्यायाधीशों में से चार महिला न्यायाधीशों की उपस्थिति न्यायपालिका के इतिहास में अब तक की सर्वाधिक संख्या है। उन्होंने कहा कि इन नियुक्तियों ने भविष्य में देश में एक महिला मुख्य न्यायाधीश का मार्ग प्रशस्त किया है। उन्होंने जोर देकर कहा कि वास्तव में एक न्यायपूर्ण समाज की स्थापना तभी संभव होगी जब न्यायपालिका सहित सभी क्षेत्रों में महिलाओं की सहभागिता बढ़ेगी। श्री कोविंद ने कहा कि वर्तमान में सर्वोच्च न्यायालय और उच्च न्यायालयों में कुल मिलाकर महिला न्यायाधीशों की संख्या 12 प्रतिशत से भी कम है। उन्होंने कहा कि अगर हमें अपने संविधान के समावेशी आदर्शों को हासिल करना है तो न्यायपालिका में भी महिलाओं की भूमिका को बढ़ाना होगा।
राष्ट्रपति ने कहा कि उन्होंने न्याय पाने के लिए गरीबों के संघर्ष को बहुत निकट से देखा है। न्यायपालिका से सभी को उम्मीदें हैं, फिर भी आमतौर पर लोग अदालतों की मदद लेने से हिचकिचाते हैं। न्यायपालिका में लोगों के विश्वास को और बढ़ाने के लिए इस स्थिति को बदलने की आवश्यकता है। यह हम सभी का उत्तरदायित्व है कि समय पर न्याय मिले, न्याय व्यवस्था कम खर्चीली हो, निर्णय आम आदमी की समझ में आने वाली भाषा में हो, विशेषकर महिलाओं और कमजोर वर्गों को न्यायिक प्रक्रिया में न्याय मिले। उन्होंने कहा कि यह तभी संभव होगा जब न्यायिक प्रणाली से जुड़े सभी हितधारक अपनी सोच और कार्य संस्कृति में आवश्यक बदलाव लाएंगे और संवेदनशील बनेंगे।
राष्ट्रपति ने कहा कि लंबित मामलों के निपटारे में तेजी लाने से लेकर अधीनस्थ न्यायपालिका की कार्यकुशलता बढ़ाने तक, न्यायपालिका में आम जनता का विश्वास बढ़ाने के लिए कई पहलुओं पर निरंतर प्रयास करना समय की मांग है। उन्होंने कहा कि अधीनस्थ न्यायपालिका के लिए पर्याप्त सुविधाओं की व्यवस्था, न्यायाधीशों की संख्या में वृद्धि और बजट के प्रावधानों के अनुसार पर्याप्त संसाधन उपलब्ध कराने से हमारी न्यायिक प्रक्रिया सुदृढ़ होगी। उन्होंने विश्वास जताया कि कि इलाहाबाद उच्च न्यायालय राज्य सरकार के सहयोग से ऐसे सभी क्षेत्रों में एक अनुकरणीय उदाहरण प्रस्तुत करेगा।
राष्ट्रपति श्री राम नाथ कोविंद ने उत्तर प्रदेश राष्ट्रीय विधि विश्वविद्यालय के लिए प्रयागराज के चयन का उल्लेख करते हुए कहा कि प्रयागराज की प्रमुख पहचान शिक्षा के केंद्र के रूप में रही है। इलाहाबाद उच्च न्यायालय की महत्वपूर्ण भूमिका और शिक्षा के केंद्र के रूप में प्रयागराज की प्रतिष्ठा को देखते हुए यह इस विधि विश्वविद्यालय के लिए आदर्श स्थान है।
राष्ट्रपति ने कहा कि न्याय आधारित प्रणाली के नियम को सुदृढ़ बनाने में गुणवत्तापूर्ण कानूनी शिक्षा एक महत्वपूर्ण भूमिका निभाती है। विश्व स्तरीय कानूनी शिक्षा हमारे समाज और देश की प्राथमिकताओं में से एक है। उन्होंने कहा कि ज्ञान अर्थव्यवस्था के इस युग में हमारे देश में ज्ञान महाशक्ति बनने की महत्वाकांक्षी नीति कार्यान्वित की जा रही है। उत्तर प्रदेश राष्ट्रीय विधि विश्वविद्यालय की स्थापना इसी दिशा में बढ़ाया गया एक कदम है।
राष्ट्रपति श्री कोविंद ने कहा कि किसी भी संस्थान के लिए प्रारंभ में ही सुविचारित तरीके से सभी पद्धतियों की स्थापना करना अपेक्षाकृत आसान होता है। जैसे ही प्रणाली स्थापित हो जाती है इसमें सुधार लाने की प्रक्रिया जटिल होती जाती है। इसलिए, उन्होंने सभी हितधारकों से उत्तर प्रदेश राष्ट्रीय विधि विश्वविद्यालय में आरंभ से ही सर्वश्रेष्ठ व्यवस्थाओं को अपनाने की अपील की। उन्होंने कहा कि आधुनिक सुविधाओं का निर्माण, छात्रों का चयन, शिक्षकों की नियुक्ति, पाठ्यक्रमों की तैयारी, शिक्षाशास्त्र की शैलियों का चयन आदि सभी पहलुओं में विश्व के सर्वश्रेष्ठ पद्धतियों को कार्यान्वित करने के द्वारा एक विश्व स्तरीय संस्थान का निर्माण किया जाना चाहिए।

If we have to achieve the inclusive ideals of the Constitution, then the role of women in the judiciary also needs to be increased: President Shri Kovind
President Shri Ram Nath Kovind said that if we have to achieve the inclusive ideals of our Constitution, then there is a need to increase the role of women in the judiciary as well. He was speaking at the foundation stone laying ceremony of the new building complex of Uttar Pradesh National Law University and Allahabad High Court in Prayagraj, Uttar Pradesh today (September 11, 2021).
The President referred to the historic decision of the Allahabad High Court in 1921 to nominate India's first woman lawyer, Ms. Cornelia Sorabji, as a visionary decision towards women's empowerment. A new history of women's participation in the judiciary was created with the appointment of nine judges, including three women judges, to the Supreme Court last month, she said. He said that out of the total 33 judges appointed in the Supreme Court, the presence of four women judges is the highest ever in the history of the judiciary. He said that these appointments have paved the way for a woman Chief Justice in the country in future. He emphasized that the establishment of a truly just society would be possible only when the participation of women in all spheres including the judiciary increased. Mr Kovind said that at present the total strength of women judges in the Supreme Court and High Courts is less than 12 per cent. She said that if we have to achieve the inclusive ideals of our Constitution, then the role of women in the judiciary also has to be increased.
The President said that he has closely observed the struggle of the poor to get justice. Everyone has expectations from the judiciary, yet people generally hesitate to take the help of the courts. This situation needs to be changed in order to further enhance the confidence of the people in the judiciary. It is the responsibility of all of us that justice should be done on time, the judicial system should be less expensive, the decision should be in the language understandable by the common man, especially women and weaker sections get justice in the judicial process. He said that this would be possible only when all the stakeholders associated with the judicial system bring necessary changes in their thinking and work culture and become sensitive.
The President said that from expediting the disposal of pending cases to enhancing the efficiency of the subordinate judiciary, it is the need of the hour to make continuous efforts on many aspects to increase the confidence of the general public in the judiciary. He said that by providing adequate facilities for subordinate judiciary, increasing the number of judges and providing adequate resources as per the provisions of the budget, our judicial process will be strengthened. He expressed confidence that the Allahabad High Court would set an exemplary example in all such areas with the cooperation of the State Government.
Referring to the selection of Prayagraj for the Uttar Pradesh National Law University, President Shri Ram Nath Kovind said that Prayagraj has been recognized as a center of education. Given the important role of the Allahabad High Court and the reputation of Prayagraj as a center of education, it is an ideal location for this law university.
The President said that quality legal education plays an important role in strengthening the rule of justice based system. World class legal education is one of the priorities of our society and country. He said that in this era of knowledge economy, an ambitious policy of becoming a knowledge superpower is being implemented in our country. The establishment of Uttar Pradesh National Law University is a step in this direction.
President Shri Kovind said that it is relatively easy for any institution to establish all the systems in a well thought out manner from the very beginning. Once the system is established, the process of improving it becomes complicated. Therefore, he appealed to all the stakeholders to adopt the best practices in Uttar Pradesh National Law University from the very beginning. He said that a world class institution should be built by implementing world best practices in all aspects like creation of modern facilities, selection of students, appointment of teachers, preparation of courses, selection of styles of pedagogy etc.
